Copyright Infringement Suit – Burna Boy Out of Court Bailiff’s Radar

Insecta Limited’s ₦20,000,000 (Twenty Million Naira) suit  for copyright infringement against Nigerian Musician Damini Ebunoluwa Ogulu (a.ka.Burna Boy) has suffered  a major setback as the Bailiffs of Court have not been able to effect service of the Originating Processes on the  popular musician.

In an ex-parte motion filed by counsel to Insecta Limited (the Plaintiff) and made available to our correspondence, Insecta is seeking an order of court granting them leave to serve the originating processes by substituted means.

In an 8 paragraph Affidavit deposed to in support of the ex-parte motion, Insecta alleged that the Sheriff of the Honourable Court known as Mr. Moruf Shobowale has served the originating processes on the 2nd and 3rd Defendants but has made several attempts to serve on Burna Boy to no avail.

The Sheriff of Court is alleging that attempts to serve the processes on Burna Boy were made on 2nd, 5th and 6th of June, 2017 without success. The Affidavit also alleged that

The Motion is therefore seeking an order to serve the motion by pasting same at the last known address of the 1st Defendant (Burna Boy) at No. 19B, Prince Bode Adebowale Crescent, Lekki Phase 1, Lagos State.

It would be recalled that Insecta Limited is suing Burna Boy for copy right infringement on its artistic work.
