Judge Recuses Himself from Ashimole’s Suit Against CAC on Day of Judgment

The presiding Judge in the suit filed by Ashimole Felix, Esq against the Corporate Affairs Commission and 3 Others, was on the court’s Cause List for Judgement, however, in a dramatic twist, the Judge declined to read the Judgment, instead informed both parties, that he is withdrawing from the matter and would be sending the Case File to the CJ for reassignment to another court.

The case with originating motion No: CV/1413/18 brought before the High Court of Federal Capital Territory by Ashimole Felix Chukwuma against the Corporate Affairs Commission and 3 others, came up before the FCT High Court two (2).

In the suit, Ashimole Felix is seeking damages of N10,000,000 (Ten Million Naira) Only against CAC for denying him access to the premises of CAC to carry out his duties to his client. According to Mr. Ashimole, CAC used Police to stop him from entering CAC in November 2017 despite his having pending jobs with CAC, jobs he had fully paid CAC.

CAC in its Counter Affidavit, complained about numerous publications in Kubwa Express and protests by Ashimole Felix against poor service delivery at CAC. Series of protests that the management of CAC found uncomfortable, as such protests, exposed the rot in CAC.
We await the new Court the matter would be assigned to and if CAC, will retain the services of a Senior Advocate of Nigeria like they did in this just reassigned case.
