The Federal High Court in Lagos has fixed June 2 to hear an application by a former Abia State governor, Senator Orji Uzor Kalu, seeking his release from prison.
The motion on notice which would be heard by Justice Mohammed Liman was filed on Kalu’s behalf by a team of 12 lawyers which includes six SANs.
His application seeks Court’s order for his release following the release of his co convict Udeogu by the Supreme Court on May 8. The Supreme Court had held that the fiat issued to Justice Idris to conclude their criminal trial after he had been elevated to the Court of Appeal was “a nullity”.
It would be recalled that Justice Mohammed Idris, convicted Kalu and a former Director of Finance in the Abia State Government House, Ude Jones Udeogu, of the offence.
Kalu and Udeogu were serving 12-year and 10-year jail terms respectively prior to the Supreme Court Judgement setting Udeogu free.
Kalu who has since been serving his jail term at the Correctional Service Centre in Kuje, Abuja contends that there is no legal basis for his continued incarceration following the Supreme Court’s judgment which declared his trial a nullity and freed Udeogu.
