A Federal High Court sitting in Kaduna has mandated the Nigeria Data Protection Commission(NDPC) to provide clarity on the entitles\u00a0\u00a0 exempted\u00a0 from\u00a0 the\u00a0 Guidance Notice\u00a0 on\u00a0 Registration\u00a0 of Data Controllers\u00a0 and Data Processors\u00a0 of\u00a0 Major Importance.<\/p>\n

The court made the order while delivering judgment in an Originating Motion filed by Frank Ijege seeking a declaration of the court that the Guidance\u00a0 Notice\u00a0 on\u00a0 Registration of Data Controllers\u00a0 and Data\u00a0 Processors of Major Importance\u00a0 NDPC\/HQ\/GNNOL.02\/24 issued by the NDPC interferes with\u00a0 his right to privacy\u00a0 guaranteed by section 37 of the Constitution of the Federal\u00a0 Republic\u00a0 of Nigeria\u00a0 1999.<\/p>\n

Some of the reliefs sought by the applicant are in the suit argued before Justice Aikawa were;<\/p>\n

A declaration that contrary to the Guidance Notice\u00a0 on\u00a0 Registration\u00a0\u00a0 of Data Controllers and Data Processors of Major Importance NDPC\/HQ\/GN\/VOL.02\/24, issued by the NDPC, not all individuals or entities are data controllers or processors of major importance.<\/p>\n

A declaration that the NDPC ought to provide clarity\u00a0 on the entitles exempted from the\u00a0 Guidance\u00a0 Notice\u00a0\u00a0 on\u00a0 Registration\u00a0\u00a0 of Data Controllers and Data Processors of Major Importance NDPC\/HQ\/GN\/VOL.02\/24.<\/p>\n

An order\u00a0 mandating\u00a0\u00a0 the\u00a0 NDPC\u00a0 to prescribe entities who fall\u00a0 under the category of controllers\/processors\u00a0 NOT of major\u00a0 importance.<\/p>\n

In his judgment, the Honourable Court held as follows:<\/p>\n

On the whole therefore.\u00a0 I find merit in this action.\u00a0 Accordingly.\u00a0 l hereby grant the following reliefs:<\/p>\n

I hereby declare paragraph that 1 (2); paragraph 2(2)\u00a0 (f) and\u00a0 (h); paragraph\u00a0\u00a0 2(3)(g) and\u00a0\u00a0 (i );\u00a0\u00a0 paragraph\u00a0\u00a0\u00a0 3 (1 )(e)(i);\u00a0\u00a0 and\u00a0\u00a0 paragraph 3( 1 )(e)(iv) of the Respondent\u2019s Guidance\u00a0\u00a0\u00a0\u00a0 Notice\u00a0\u00a0\u00a0\u00a0 on Registration\u00a0 of Data\u00a0 Controllers and Data Processors\u00a0 of Major\u00a0 Importance NDPC\/HQ\/GN\/VOL.02\/24 are ultra vires,\u00a0 null and void.<\/li>\n<\/ol>\n
      \n
    1. That I hereby declare that the Respondent ought to provide clarity on the entitles exempted\u00a0\u00a0 from the \u00a0Guidance\u00a0\u00a0\u00a0 Notice\u00a0 on\u00a0 Registration\u00a0 of Data Controllers \u00a0and Data Processors of\u00a0\u00a0\u00a0\u00a0\u00a0 Major \u00a0Importance NDPC\/HQ\/GN\/VOL.02\/24 1s confusing and it requires further clarification,<\/li>\n<\/ol>\n

      1. That I hereby order mandating the Respondent to prescribe entities who fall under the category of controllers\/processors NOT of major importance as contemplated by section 48(3)(b) of the Nigeria Data Protection Act, 2023.<\/li>\n<\/ol>\n

That I hereby order the striking out paragraph 1(2); paragraph 2(2) (f) and (h); paragraph 2(3)(g) and (i); paragraph 3(l)(e)(i); and paragraph 3(l)(e)(iv) of the\u00a0 Guidance\u00a0\u00a0 Notice\u00a0 on\u00a0 Registration\u00a0 of Data\u00a0 Controllers\u00a0 and\u00a0 Data Processors of Major Importance NDPC\/HQ\/GN\/VOL.02\/24.<\/li>\n<\/ol>\n
