The National Industrial Court sitting in Bauchi has dismissed a suit filed by Mr. Ubayo Juji against Federal University Gashua and its Governing Council over his dismissal from service.<\/p>\n\n\n\n
Delivering judgment, the Presiding Judge, Hon. Justice Mustapha Tijjani, ruled that the claimant failed to prove that his dismissal was unlawful, irregular, or in violation of his right to fair hearing and due process.<\/p>\n\n\n\n
Mr. Juji had asked the court to declare his dismissal null and void, set it aside, and order his reinstatement with full benefits, along with the payment of damages. He argued that the disciplinary action taken against him did not comply with the institution\u2019s conditions of service and that he was denied a fair hearing.<\/p>\n\n\n\n
However, the defendants maintained that a verification of his employment records uncovered discrepancies. They told the court that correspondence from Bauchi State University and Federal Polytechnic Bauchi indicated that Mr. Juji submitted questionable academic credentials. The university further argued that the claimant provided misleading information that influenced his employment and subsequent promotion.<\/p>\n\n\n\n
In its ruling, the court held that Mr. Juji was given adequate opportunity to defend himself. Evidence showed that he responded to queries through his lawyers and appeared before an investigative panel set up by the university and its governing council.<\/p>\n\n\n\n
Justice Tijjani noted that the claimant could not claim denial of fair hearing after admitting that he appeared before the disciplinary committee and presented his case.<\/p>\n\n\n\n
The court also found that documentary evidence, including responses from the institutions mentioned, revealed inconsistencies in Mr. Juji\u2019s academic and employment records, as well as concealment of material facts.<\/p>\n\n\n\n
