A Lagos State High Court sitting in Ikorodu has delivered a landmark ruling on digital privacy, ordering the anonymous operator of a Twitter\/X parody account to pay \u20a620 million in damages to a young Nigerian student whose birthday post was allegedly doctored and used to humiliate her online – while directing tech giant X Corp to hand over the user’s identity or risk a \u20a650 million penalty of its own.<\/div>\n

Delivering judgment on Friday, June 5, 2026, in Suit No. IKD\/21207MFHR\/2026, Hon. Justice A.F. Pokanu of the Lagos State High Court, Ikorodu Judicial Division, held that the actions of an unknown individual operating the parody account “@boutmoney112” amounted to a clear breach of the applicant’s constitutional right to privacy under Section 37 of the 1999 Constitution, as well as violations of Nigeria’s Data Protection Act (NDPA), 2023.<\/div>\n

The Backstory<\/div>\n
<\/div>\n
The case was brought by Esther Agboola, a student who runs the Twitter\/X handle @agirlnamed_esth. According to her affidavit, she posted a set of pictures on January 9, 2026, captioned “Chapter 25. Happy Birthday to me!” to mark her 25th birthday.<\/div>\n
<\/div>\n
She alleged that the operator of the parody account subsequently dug up an old post from January 2025, where she had celebrated her 24th birthday, and digitally altered its timestamp to make it appear the post was originally made in January 2022. The court found that this manipulation created a false narrative suggesting Agboola had lied about her age, a claim she said triggered a wave of cyberbullying, harassment, public ridicule and mental distress.<\/div>\n

Agboola, represented by Dr. Olumide Babalola alongside M. Owodunni and H. Tofi, sued both X Corp (the owner of the platform, as 1st Respondent) and the unidentified account operator (2nd Respondent), seeking declarations, damages, and\u00a0 crucially, an order compelling X Corp to unmask the anonymous user. Neither respondent filed any defence or appeared in court.<\/div>\n

What the Court Found.<\/div>\n

Justice Pokanu held that:<\/div>\n

The unauthorized manipulation, alteration and republication of Agboola’s post violated her right to privacy under Section 37 of the Constitution, citing precedents including Emerging Markets Telecommunication Services Ltd v. Barr Godfrey Eneye (2014) and Incorporated Trustees of Digital Rights Lawyers Initiative & Ors v. NIMC (2021), which established that privacy protections extend beyond physical spaces to personal data and online communications.<\/div>\n

The alteration of the post’s timestamp breached Section 24(1)(a) of the NDPA, which requires personal data to be processed lawfully, fairly and transparently, and Section 24(1)(e), which requires that data remain accurate and not misleading.<\/div>\n

X Corp, as a data controller operating in Nigeria and processing the data of millions of Nigerian users, has an obligation to assist in identifying the perpetrator of a rights violation, drawing on Nigeria’s Data Protection Act and the NITDA Code of Practice for Interactive Computer Service Platforms.<\/div>\n

The Orders<\/div>\n

The court ruled in Agboola’s favour on all counts and ordered:<\/div>\n

1. \u20a620,000,000 in general damages against the anonymous 2nd Respondent for mental anguish, emotional distress, harassment, reputational injury and humiliation.<\/div>\n

2. X Corp to file an Affidavit of Disclosure within 14 days, revealing the 2nd Respondent’s full name, contact details, means of identification, and any other data that could help locate them.<\/div>\n

3. A conditional \u20a650,000,000 in general damages against X Corp \u2014 payable only if the company fails, refuses, or neglects to comply with the disclosure order.<\/div>\n

Why It Matters<\/div>\n

Legal observers say the judgment is one of the more assertive applications yet of Nigeria’s 2023 Data Protection Act against a foreign-domiciled social media company, and adds to a small but growing body of Nigerian case law treating “privacy of the citizen” as extending to personal data shared online, not just the home, mail or phone calls traditionally covered by Section 37 of the Constitution.<\/div>\n

The ruling also signals that Nigerian courts may increasingly be willing to compel platforms to identify anonymous users behind harassment or impersonation, similar to disclosure orders that have been made by courts in the Netherlands and elsewhere, which were cited during arguments in the case.<\/div>\n

Neither X Corp nor the operator of @boutmoney112 filed any response in the suit, and it remains to be seen whether the platform will comply with the disclosure order or contest the judgment.<\/div>\n
